MMLA Legal Assistant Helps Client Recover from Fraudulent Lawyer Costs
Sergio was in trouble on his mortgage and heard an ad for mortgage relief services on Spanish language radio. He paid a California lawyer who promised to fix the foreclosure problem. The lawyer took thousands of dollars from Sergio and did nothing. Sergio went to NeDA, the Neighborhood Development Alliance, a community organization that serves the Spanish-speaking community. NeDA referred Sergio to Mid-Minnesota Legal Aid.
MMLA knew that these actions were illegal under a Minnesota law that MMLA helped design, but that suing the lawyer in Minnesota probably would have been unsuccessful. Instead, Legal Assistant Pedro Pinner from the homeowners’ fair housing team helped Sergio file a claim with the California Client Security Fund – a program that California lawyers pay into so that people who are harmed by cheating lawyers are reimbursed for financial losses.
Last month, Sergio received a check from the California Client Security Fund covering the entire amount he had paid to the cheating lawyer (who had earlier been disbarred).
